Environmental Impact Assessment legislation

Environmental impact assessment is carried out in accordance with the provisions stipulated in the Law "On Environmental impact assessment", passed on October 14, 1998.

Initially in the Law "On Environmental impact assessment" had been incorporated legal provisions resulting from Directives 85/337/EEC, 97/11/EC, Council Directive of 27 June 1985 on the assessment of the effects of certain public and private projects on the environment and Council Directive 97/11/EC of 3 March 1997 amending Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment.

In order to make the existing legislation in compliance on environmental impact assessment in Latvia with the corresponding European Union Directives since 14 October 1998, amendments has been made in Law “On Environmental impact assessment”:

  • Amendments of 30 May 2001 corresponding Convention of 25 February 1991 on Environmental Impact Assessment in a transboundary Context;
  • Amendments of 19 June 2003 in the Law incorporate legal provisions resulting from the Directives 92/43/EEC, 2001/42/EC,
  • Amendments of 26 February 2004 in the Law incorporate legal provisions resulting from the Directives 2003/35/EC and 92/43/EEC.

Thereby in the Law “On Environmental impact assessment” incorporated legal provisions resulting from the Directives 85/337/EEC, 97/11/EC, 92/43/EEC, 2001/42/EC, 2003/35/EC and 92/43/EEC.

Based on the Law “On Environmental impact assessment”, stipulated Cabinet of Ministers regulations:

The activities of the bureau in a transboundary context are prescribed by 1991 Espoo Convention on Environmental Impact Assessment in a Transboundary Context, which Latvia had acceeded on July 1, 1998 and the Agreement   between the Government of the Republic of Latvia and the Government of the Republic of Estonia on Environmental Impact Assessment in a Transboundary Context, signed in March 14, 1997.

Integrated Pollution Prevention and Control legislation

Integrated Pollution Prevention and Control is carried out in accordance with the provisions stipulated in the Law "On Pollution", passed on 15 March, 2001, came into force on 1 July 2001.

Initially in the Law "On Pollution" had been incorporated legal provisions resulting from Council Directive “96/61/EC” of 24 September 1996 concerning Integrated Pollution Prevention and Control.

In order to make the existing legislation in compliance on Integrated Pollution Prevention and Control in Latvia with the corresponding Council Directive since 24 September 1996, amendments of 18 December 2003 has been made in Law “On Pollution”.

Thereby in the Law “On Pollution” incorporated legal provisions resulting from the Directives 96/61/EC, 2003/35/EC, 91/676/EEC and 2002/49/EC, 2003/87/EC.

Based on the Law “On Pollution”, Cabinet of Ministers regulations No 294 of 9 July 2002 “Regulations on the procedure for the notification of category A, B and C polluting activities and issuing category A and B permits” are stipulated.

Industrial Accident Risk Assessment and Risk Reduction

"Regulations regarding the Procedures for Industrial Accident Risk Assessment and Risk Reduction Measures" Regulations of the Cabinet of Ministers No. 532, adopted on 19.07.2005.

EU Directives

Existing legislation in Latvia on environmental impact assessment, IPPC and industrial accident risk assessment and risk reduction is in conformity with relevant EU directives:

  • Council Directive 85/337/EEC of 27 June 1985 on the assessment of the effects of certain public and private projects on the environment, and Council Directive 97/11/EC of 3 March 1997 amending Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment.
  • Council Directive 96/61/EC of 24 September 1996 concerning integrated pollution prevention and control
  • Council Directive 96/82/EC of 9 December 1996 on the control of major-accident hazards involving dangerous substances
